Psychopathological symptoms revealed by a party to a notarial act and its legal capacity

The Notary Public Law prohibits performing notarial acts if the notary public doubts whether the party to the notarial act has capacity to perform acts in law. Here, among other things, situations in which there is a lack of awareness or freedom to make a declaration of will. Experts in the field of psychiatry and psychology appointed in cases concerning the assessment of the validity of a legal act have access to a wide range of research material: the results of their own clinical examinations, testimonies of witnesses, various material evidence and medical documentation. Their task is to make a medical diagnosis, reconstruct mental state of the person participating in the notarial act, and then to comment on the disposition of the declaration of will specified in Art. 82 CC. The notary public is not able to verify medical diagnoses or categorically express their awareness or freedom of decision and expression of will during the notarial act. To a certain extent, however, they may obtain information about the party to the action already at the stage of preparation the notarial deed (data of the persons who participate in the notarial deed, assessment of the place where the action was performed, knowledge about the life situation of the party, its preferences, life problems, family relationships). Another opportunity to obtain information about the nature of the property decision is to analyse the content of the notarial deed itself and compare it with previous property decisions. The last of the possible circumstances is the notarial deed itself, when the observation of the nature of the relationship between persons performing the act as well as assessment of the behaviour and statements of the party to the act may indicate the presence of disturbing symptoms. On that stage it is possible to isolate those symptoms that raise greatest doubts for the notary. In this way, it can make assessments in the field of: orientation, psychomotor drive, mood, contact, concentration of attention, memory, perception ability, content of thinking and others that may raise the suspicion of mental abnormalities in the client. The point is only for the notary to make sure of the doubts that will be the basis for withdrawing from the notarial act, and not for obtaining certainty as to the legal capacity of the party.
