Legal Titles to Property for the Location of Solar Photovoltaic Installations in Poland and Hungary

Investments in renewable energy sources play an important economic role, which justifies the need for in-depth analysis of the legal issues accompanying them and a broader discussion on the shape of the applicable regulations. One of the first elements of investing in renewable energy sources is securing legal title to real estate (determining the success and stability of the investment). The aim of this article is to discuss models for obtaining legal title to real estate for the location of photovoltaic installations in Poland and Hungary. This allows for the identification of problems that arise in connection with the practical application of individual legal titles as presented in a comparative legal context. De lege lata, the application of property law instruments, is legally complex and depends on the specific situation. De lege ferenda, it is necessary to strengthen the legal certainty of investors, which can only be achieved by promoting long-term instruments of securing legal title to real estate.
