Property law methods of securing investments in renewable energy sources in Austria

Austria is one of the leaders in the European renewable energy market. The country aims to achieve climate neutrality by 2040. Favorable geographical conditions and legislative initiatives have contributed to the development of a stable model for hydropower development. However, the potential for hydropower development is not significant. In view of Austria’s commitments to achieve climate neutrality, it is therefore necessary to seek ways to increase the level of renewable energy production from other sources. With the dynamic development of the wind and solar energy sectors, there is a need to create new organizational and legal solutions that enable the effective use of real estate or parts thereof for investments in renewable energy sources. This article presents a general overview of the renewable energy market in Austria. Market needs, in light of the country’s climate commitments, are compared with an analysis of legal institutions that optimally protect the interests of parties involved in investments, providing an opportunity to increase the stability of the renewable energy market.
