Energy Solidarity and Strategic Raw Materials Security in German-Polish Relations – Regulatory Potential of the CRMA

This article examines the legal governance mechanisms of energy solidarity and strategic raw materials security in the relationship between Germany and Poland. It focuses on the extent to which the Critical Raw Materials Act (CRMA), as an instrument of EU law, can contribute to securing supply, diversification and investment security. The article also analyses the ownership unbundling models of the internal energy market and their relevance for solidarity under Article 194(1) TFEU. In addition, national property-law security instruments, such as the German hereditary building right (Erbbaurecht) and the Polish right of perpetual usufruct, are presented and compared with regard to their potential for harmonisation. The study shows that a coherent link between energy solidarity, property protection and investment law can contribute to strengthening European energy and raw materials resilience.
