Abstract

The critical commentary analyses the judgment of the Supreme Administrative Court of 16 October 2025 (I FSK 1342/22), in which it was held that erotic performances transmitted online may constitute a cultural service exempt from VAT. The paper points out the problems associated with the criteria adopted by the court to distinguish between erotica and pornography. It emphasises the fluid boundary between these phenomena and the interpretative difficulties arising from the digital consumption of sexual content. In conclusion, the author postulates the need to clarify the tax law provisions concerning the issues addressed in the commented judgment.
