AI Advancements and GDPR Obligations Regarding the Content of Personal Data Processing Notices: Challenges for Public Administration in Poland

The integration of artificial intelligence systems into public administration in Poland raises significant compliance challenges under the EU General Data Protection Regulation (GDPR). This article examines the content requirements for personal data processing notices, the primary transparency instrument under GDPR Articles 13 and 14, as they apply to AI systems deployed by Polish public bodies. The article argues that AI systems create genuine and previously underappreciated challenges for fulfilling transparency obligations, particularly the requirement to provide “meaningful information about the logic involved” under Article 13(2)(f) of the GDPR. The analysis identifies three temporally and functionally distinct disclosure obligations arising from the intersection of GDPR, the EU AI Act, and Poland’s Administrative Procedure Code, and demonstrates that processing notices under GDPR Article 13 occupy an irreplaceable ex ante role that cannot be substituted by procedural transparency requirements.
