This article presents selected issues concerning the performance of substitution duties by a retired notary. First, it discusses the evolution of the legal provisions governing the appointment of a retired notary as a substitute, while highlighting interpretative doubts arising from the linguistic interpretation of Articles 21 and 22 of the Notarial Law. The article also examines the issue of the qualifications and competencies of a retired notary performing duties within the framework of such substitution, particularly in relation to the requirements imposed on notaries when carrying out notarial acts, including the obligation of continuous professional development. Attention is also drawn to the absence of restrictions on activities undertaken by a retired notary that could undermine the dignity of the profession or conflict with the duties performed in the course of substitution.
