Commentary to the judgment of the Provincial Administrative Court in Kraków from September 6, 2018 (II SAB/Kr 113/18-LEX 2562431)

Abstract

y. The present article outlines the analysis of the judgment of the Provincial Administrative Court from September 6, 2018 (II SAB/Kr 113/18-LEX 2562431). The commented judgment is one of the series given by administrative courts in connection with the activity of the organization “Sieć Obywatelska – Watchdog”, which in May 2018 made requests to over 30 selected parishes in Poland for the access to the public information. The main goal of this activity was to find out the price list of cemetery services, the amount of money received from fees, as well as the number of buried people. The subject of the discussion set out in the study is the assessment of the scope of obligations of Roman Catholic parishes to reveal public information related to the running of religious cemeteries. The author takes the view that this obligation applies only to cases where, in the absence of a communal cemetery, people who do not identify with the Catholic Church are buried at the Catholic cemetery.
