The Digital transformation of the Polish common judiciary

Abstract

The given study relates to the phenomenon and mechanisms of digital transformation of the Polish judiciary, takes into account in this process the absolute necessity of preserving the right to court for everyone on an equal basis, diagnoses the risks associated with computerization, describes the areas of new technologies currently being used in the judiciary, and estimates the benefits and costs of digitizing the state’s activities in the administration of justice. The compiled study also aims to outline further areas of digitization of the judiciary while preserving elements of the current model and standards of the judiciary, as well as established legal traditions. At the same time, it demonstrates that the progressive digital transformation must not overlook such important principles of the judiciary as the right to court and equal access to it, openness of proceedings, impartiality, professionalism, as well as fair and public consideration of a case, without undue delay by a competent, independent and impartial court.
